The inspection aviary Mexican Revolution Ecological Park Puebla, conducted by the Federal Attorney for Environmental Protection (PROFEPA), from September 24 to October 1, 2014, was made in response to several citizen complaints for alleged abuse and trafficking exotic birds.
The Federal Delegation of PROFEPA in the state reported that on February 9 was notified Camacho C. Martín Morales, former head of the aviary, the decision of the administrative procedure initiated by this office against him.
In it he states that committed the offenses set out in Article 122, Fractions II and X of the General Wildlife Act, which resulted in a fine of $ 168,225.00 (one hundred sixty-eight thousand two hundred twenty-five pesos 00/100, MN ).
Also, the confiscation of 105 copies ordered wildlife.
The Federal Delegation of PROFEPA in the entity indicated that the performance of this Office focused on verifying: the physical condition of the birds and their legal provenance; documents the establishment, in order to verify if you have proper authorization to handle such copies; and inventory of species and specimens found in that place.
He noted that the actions of the delegation focused on the care of the complaint, the care of the copies and verifying the legal origin thereof.
Given the irregularities the precautionary seizure of 316 specimens of wild, these animals that remained under guard and responsibility of the inspected, who according to environmental legislation had five working days to prove the legal origin was performed.
The inspected Martin Camacho Morales, in his capacity as manager of the aviary, presented various documents to prove the legal origin of wildlife that once was sent to receipt by the Secretariat of Environment and Natural Resources (SEMARNAT) and PROFEPA.
However, there were 105 individuals who wanted to prove by letters of donation and remitting sales notes, which do not comply with the provisions of legal provenance identified in the General Wildlife Act and Regulations.
Furthermore, it did not prove to have the date of the Management Unit for the Conservation of Wildlife (UMA) record and confirmed that operated without a management plan approved by SEMARNAT and omitted the presentation of annual activity reports; these are all requirements of General Wildlife Act.
On November 14 the inspected Martín Morales Camacho asked resguardante change or custodian of wildlife.
On November 19, 2014, conducted the proceedings of change circumstantial depositary of birds, Mr. Martin Camacho to the State Government through the decentralized public agency called «Conventions and Parks».
On 26 January 2015 the decentralized public agency called «Conventions and Parks» requested the change of depository of birds for the relocation of «Bird of Puebla» to «Forest Flower», which was authorized dated January 26, 2014 and was documented by detailed affidavit completed last February 2, 2014.
The relocation of animals was counted with the support of African Safari staff who took all possible provisions to ensure the lowest number of deaths of animals, since in the work of containment and management is common risk.
Before, during and after moving 23 individuals died, whose casualties are not related to situations of neglect.
On February 3, 2015 ruling was issued to administrative proceedings resolved:
– The C. MARTIN MORALES CAMACHO, committed the offenses set out in Article 122, Fractions II and X of the General Wildlife Act, imposing a fine of $ 168,225.00 (one hundred sixty-eight thousand two hundred twenty-five pesos 00/100, MN ).
– Confiscation of 105 specimens of wildlife is ordered.
On February 9, 2014 via INSTRUCTION was notified inspected C. MARTIN MORALES CAMACHO of the aforementioned resolution.
